Police Misconduct Lawyers in Chandler, AZ

Do you think you might have a police misconduct case in Chandler, Arizona? Civil rights law and seeking compensation where you have been wronged by the government, is a legally complex and usually overwhelming thought. Indeed, standing up against a police officer, corrections officer or other government officials can be a scary and confusing proposition. At Attorney for Freedom Law Firm, we routinely represent people who have had their civil rights violated under both state law as well as the federal statute 42 USC § 1983. We have experience in standing up for ordinary people against the government. Fighting the government is what we do.

Possible cases may include:

  • Excessive force and police brutality, including unjustified shootings and Taser cases
  • Unlawful restraints such as hogtie, hobbling, and suffocation/asphyxia from excessive force
  • False arrest and wrongful imprisonment
  • Jail and prison injuries, against governmental agencies and actors for sexual abuse, discrimination, harassment, and other abuses of state power

Police Brutality is a Violation of Your Civil Rights
Long gone are the days when the government had bridled sovereign immunity. Things have now changed, all thanks to the Federal Tort Claim Act FTCA, which allows individuals to sue the government for a perceived injury caused by a government agency. Through the Federal Tort Claims Act (FTCA), the government can partially abort its immunity for certain acts of commission or omission done by its employees, including but not limited to medical malpractice and accidents. The FCTA allows you to sue for compensation when you suffer losses or damages by the action or inaction of Government organizations.

Determine if it is right for you to sue the government and the next steps
The FTCA may allow you to sue the government but, you as the plaintiff must have met certain pre-conditions to enjoy this privilege. The authenticity of your claim will be the first point of call. In order for you to claim the privileges of the enactment of the FTCA (privilege allowing you to sue the government), you must be able to prove the authenticity of your claim otherwise, you will not be compensated. Proving that you have been wronged by a government functionary could be difficult, and it may require the help of an attorney to make sure you have a valid claim. The Attorneys For Freedom Law Firm in Chandler Arizona can determine if you have a claim or not.

If you have been able to ascertain that you have a valid claim (you are able to sue the government), the next hurdle to pass is to follow the prescribed steps for such claims, which include some strict time limits. Before proceeding to court, it is vital that you file a notice of claim either by yourself or with the help of your attorney. The date of injury should not be more than two years ago. This means if the injury was over two years ago, you might not be eligible to file a notice of claim.

Time limit to file a lawsuit against the government
There is a grace period of about ninety days after the ruling on the notice of claim to file a lawsuit. The period sometimes differs from state to state. It is advisable to file your lawsuit as soon as possible after receiving this decision to avoid any chance of having your lawsuit dismissed as untimely. Apart from the above-mentioned procedure, there are a few other limitations to be observed so your case doesn’t get quashed in the court for lack of merit.

Although the limitations and exceptions are too numerous to review in this article, here are some general guidelines regarding the limitations on FTCA claims:

  • Only federal employees can be sued under the FTCA, not independent contractors hired by the federal government (unless they are treated like employees).
  • The negligent or wrongful conduct must have been done within the scope of the defendant’s employment.
  • In general, only claims of negligence — as opposed to intentional misconduct — are allowed (though some claims for intentional misconduct can be brought against certain federal law enforcement officers).
  • The claim must be based on — and permitted by — the law of the state in which the misconduct occurred.

Despite these and numerous other limitations on FTCA lawsuits, the federal government still pays out millions of dollars each year to compensate FTCA claims. So, if you think you may have a valid claim, it may be worth pursuing.

Think you may have a civil right, police abuse or police misconduct claim?
We handle only select civil rights matters, and not all matters rise to the level of a civil rights case. Civil rights cases can be costly, time-sensitive, and require a lot of staff hours to pursue. For this reason, we are only able to manage a limited number of civil rights cases at one time. Therefore, we carefully screen all potential civil rights cases. 5 stars just isnt enough for Andrew Marcantel, Marc Victor, and the entire staff here. When my... boyfriend was wrongly accused of a totally vile crime, neither of us had any experience navigating the "just-us" system. If you've faced potentially life-altering accusations, and you feel like the system is set up to empower police, prosecutors, judges, and pretty much everyone except you, then you're right! If you want to level the playing feild, Attorneys for Freedom will accomplish that. Some others have commented about the price. Good representation does cost money, unfortunately. What is a persons future worth?Compared to the competition, which is also expensive, the value you will get at this law firm is just unbelievable. Andrew especially is so great at walking you through possible scenerios, guiding you through important decisions, and has the experience to truly get good results. Extremely knowledgeable and creative not just "aggressive". He is also an excellent communicator, both in the office and in the court.Speaking of communication, the paralegal team at even some more expensive law firms will leave you wondering what it is they are paid to do. This is not the case at Attorneys for Freedom. Ashley Crispino and Kaylie Kline did an amazing job at both keeping us in the loop and being available when needed.Reading "Case Dismissed" after what felt like an eternity of fighting was the best outcome we could have ever asked for.I told my Aunt who was very worried about us at the height of all the absurdity that I felt like having Andy on our side was better than prayer. And I was right.read more

This is my first time ever needing an attorney and my attorney was Kate and she did an amazing job... with my case! Kate took time to go through all of the evidence so she understood everything before going to court. Kate assistant Madalyn was also super helpful and very sweet! Anytime I called she was very understanding and helped me walk through the process when I did not understand something and always had an upbeat positive attitude! If I ever need an attorney again I will definitely being going back to Kate!read more
