5 THINGS EVERY GUN OWNER OUGHT TO KNOW

Five Things Every Gun Owner Ought to Know –  As a criminal defense attorney, I have been representing people charged with gun related criminal offenses for well over twenty years.  During that time, I have been lead counsel in several hundred gun related criminal offenses including 1st-degree murder, drive-by shootings, aggravated assault, disorderly conduct, unlawful discharge and many more serious felony level offenses.  I have represented people in countless misconduct with weapons and prohibited possessor criminal charges as well. Read more>>>

DOBSON V. MCCLENNEN

On November 20, 2015, the Arizona Supreme Court decided Dobson v. McClennen which resolved the issue of whether medical marijuana cardholders, who legally use marijuana,  remain subject to DUI prosecutions for merely having a detectable amount of marijuana  (actually THC or its impairing metabolite) in their blood.  Last year, the Arizona Supreme Court determined the presence of the long lasting but non-impairing metabolite was insufficient to constitute a DUI. Read More>>>

ARE YOU A THUG?

The varied forms and structure such a society could take is restricted only by our own imaginations and creativity.  Imagine a world where independent communities can each freely experiment with rules, laws, structures, institutions, or the absence of these things, all with the goal of eradicating coercion against peaceful competent adults.  Only a market of free people can decide for themselves what works best for them.  If we truly cherish and desire freedom and peace, this ought to be our goal. Read more>>>

A CELEBRATION FOR CRIMINALS

Attorney Marc J. Victor offers his perspective of the criminal justice system and its imminent collapse under the weight of the war on drugs. The war on drugs has been a huge mistake that has ruined countless lives, destroyed families, and turned the United States from the “Land of the Free” into the “Land of the Incarcerated.” We must end the War on Drugs if we ever want to restore our criminal justice system and be the “Land of the Free” again. Read more>>>

ABOLISH ALL DUI LAWS!

We should abolish all DUI laws and replace them with nothing! I am not suggesting we should have people driving while they are a danger to others. We already have several laws that can be used to arrest someone who is a danger to others because of the way they are driving.  DUI law is simply revenue generation for the government; they do not add any protection that did not already exist in our laws to curb dangerous drunk driving. Read More>>>

ARE YOU REALLY FOR FREEDOM

If someone were to take a poll and ask the question, “who is for freedom?” the overwhelming majority of people would raise their hands in affirmation. If these same people were questioned further, we would learn that they are actually not for freedom. What they are really saying is they support the rights of others to enjoy the same freedoms they approve of themselves. Are you really for freedom? Read More>>>

BEWARE OF THE DRAGON SLAYER

Victor gives you his advice on these and other questions in, “Don’t Be Your Own Worst Enemy!” Read more>>>

DON’T CHERISH THE 2ND AMENDMENT

Should you put your faith in the Second Amendment? How does this document protect your gun rights? Mere words always need to be interpreted.  You may not always agree with the interpretations of others; especially those on the United States Supreme Court.  Don’t think you know what this article is about simply by reading the title. Attorney Marc J. Victor explains why you should not put your faith in the Second Amendment to protect your gun rights and why you should not, “Cherish the Second Amendment” but freedom instead. Read more>>>

LEGALIZE METHAMPHETAMINE!

Most people will not make it beyond the scary title of this article; but they really should. This is not just about legalizing methamphetamine, but all drugs. The question of who is in charge of your body is an important question to consider.  The drug war has been a complete failure, and it’s time we end it, just as we did with the prohibition of alcohol. In this article Attorney, Marc J. Victor will raise two separate but equally important arguments as why it is crucial to society that we end the war on drugs. Read more>>>

MEDICAL MARIJUANA AND DUI

There is still a lot of controversy and confusion on medical marijuana and what rights people have regarding medical marijuana.  Many people falsely believe they can now possess marijuana legally without any restrictions.  Although we do have medical marijuana in Arizona, it is still illegal at the federal level, and you could still be charged with a crime for possessing it. Even at the State level, there are many provisions concerning marijuana and who can legally buy, sell or possess it in Arizona. There is also a lot of confusion concerning having a medical marijuana card and how this relates to driving. Attorney Marc J. Victor tells you what you need to know concerning medical marijuana and DUI. Read more>>>

NOT GUILTY ON 83LBS AND STILL NO JUSTICE

Attorney Marc J. Victor talks about a past case involving 83 pounds of marijuana. Even though he was able to get a not guilty at trial, there was still no justice. This is a case that should have never been charged in the first place, but due to our justice system run a foul it was fought with a vengeance by the prosecutors despite the evidence for the client’s innocence. This story is just one of many examples of how the war on drugs has ruined countless lives. Read more>>>

REVOLUTIONIZING HOW WE ALL THINK ABOUT LAWYERS AND CLIENTS

Think all lawyers are the same? Nobody looks forward to hiring a lawyer.  Seeking help with legal issues is normally the rational response to some unfortunate event in a person’s life.  Lawyers normally experience this issue as a routine business transaction that begins and ends with the resolution of the client’s issue at hand.  For clients, it is generally seen as a necessary evil in an attempt to resolve some annoying, to potentially life-changing, legal problem.  Unfortunately, lawyers are routinely viewed merely as the tools of clients to resolve some legal issue as quickly and effectively as possible. THOMAS JEFFERSON CORRECTED

Thomas Jefferson, as well as the other Founding Fathers, have been credited with many thought provoking quotes. Although there is much debate about what they actually said, one thing is certain; they had mistrust in big government. One quote that has been attributed to Thomas Jefferson is, “When the people fear the government, there is tyranny. When the government fears the people, there is liberty.” Although we may never know if Thomas Jefferson actually said this or not, Attorney Marc J. Victor explains why a free society must not ever be based on fear. Read more>>>

Unsung Heroes

Criminal Defense Attorneys have the duty to represent people who have been charged with crimes. Some of these people are completely innocent, but not all of them are. As such, criminal defense attorneys also represent people who have been charged with serious crimes. When we do, the public will usually vilify the attorney for representing someone who may be guilty of a very serious offense. Few people see criminal defense attorneys as heroes, but that is exactly what they are. Attorney Marc J. Victor explains why criminal defense attorneys are not only necessary but are, in fact, “Unsung Heroes.” Read more>>>

WE DON’T NEED NO STINKING ZEALOUS ADVOCACY

Criminal Defense Attorneys take an oath to zealously defend their clients. Even though all criminal defense attorneys take this oath, some will simply hold their clients hand and walk them through the criminal justice system. However, in an Arizona Supreme Court decision it was decided that attorneys in Arizona have no such ethical duty. Attorney Marc J. Victor describes a case in which his zealous representation of a client resulted in a bar complaint filed by the prosecutor in the case. Read more>>>

WHO DO THESE PEOPLE REPRESENT

The elected County Attorney has a duty to uphold the law, not try to write it. However, the elected Maricopa County Attorney and former Governor of the State of Arizona have made it their mission to ignore the will of the voters and enforce the law based on their own views, rather than the will of the people. Although medical marijuana was passed in Arizona, the former Governor and Maricopa County Attorney have made it clear they would like to enforce their own agenda where medical marijuana is concerned. For that reason, Attorney Marc J. Victor asks, “Who do These People Represent?” Read more>>>

THE IMMORALITY OF EATING STEAK & WHY I ACKNOWLEDGE YOUR RIGHT TO EAT IT

Every once in a while, during some hotly contested debate with either a statist or another libertarian, the issue of animal rights arises.  Like most libertarians I have met, I quickly and mindlessly dismissed the issue with a terse assertion about how the Principle is simply inapplicable to “animals.” Read more>>>
