The law firm of Marc J. Victor, P.C. represents Ms. Laney Sweet and her two daughters as statutory victims in State v. Brailsford CR2016-004743-001 pursuant to the Arizona Victim’s Rights Act.

A defendant in a criminal case does not have a right to a plea offer. Whether a plea offer is tendered in a criminal case, and what specific terms are included in such a plea offer, is wholly the discretion of the prosecutor.

Although a victim in a criminal case has a constitutional right to have input into any such plea offer, the prosecutor retains complete discretion over all terms of any plea offer tendered. Victims in criminal cases have a right to be heard in court about any plea offer including asking the judge to reject any plea offer deemed to be unjust.

The law firm of Marc J. Victor, P.C. will vigorously exercise and assert the rights of our clients to advocate in court for rejection of any plea offer that our clients deem unjust. We intend to pursue justice in this case for the death of Daniel Shaver in both the criminal court and the civil court.

Just Released – Maricopa County Attorney announcement of criminal charges against Mesa Police Officer Brailsford for the Death of Daniel Shaver

On behalf of her two young daughters, the victim Laney Sweet wants everyone to know her husband Daniel Shaver was a wonderful and devoted husband and father.  He was a kind, loving and peaceful human being.  His tragic and senseless murder has caused irreparable devastation to all their lives.  Today’s announcement of 2nd-degree murder charges against Mesa Police Officer Brailsford is the first step towards justice for Daniel and his family.  We commend Maricopa County Attorney Bill Montgomery for his decision to bring these criminal charges, and we fully expect justice will be served.

The law firm of Marc J. Victor, P.C. represents Daniel Shaver’s widow, Laney Sweet,  and their two young daughters in a wrongful death action against the City of Mesa.  A thirty-five million dollar notice of claim has already been served upon the City of Mesa and is currently pending.  A civil lawsuit is expected to be filed within the next few months.

The civil lawsuit will proceed independently of the criminal case.  Marc J. Victor will represent Laney Sweet as a “victim” in the criminal matter.  An initial appearance in the criminal case has been scheduled for March 15, 2016, at 2 pm.
