Drug policy and laws in Hawaii continue to reflect the longstanding failed policies of drug prohibition. As a result, many drugs, including marijuana, remain illegal in Hawaii. Fortunately, Hawaii has adopted laws supporting medical marijuana for people who have certain medical conditions, and who have legally obtained a medical marijuana card in Hawaii.

While marijuana is becoming more socially acceptable nationwide, it also remains entirely illegal under federal law. If you are found in possession of marijuana without a valid medical marijuana card, you risk being charged with a crime and possibly ending up in jail or prison. Hawaii Revised Statutes §329-14 classifies marijuana as an illegal substance.

Regarding drug offenses generally, the seriousness of the criminal offense is often determined by the amount and type of drug that was involved. Hawaii divides the various illegal drugs into five different groups or “schedules” (I through V), based on the perceived potential harm to the user. Hawaii Revised Statutes §329-13 through §329-22 identify the classifications and seriousness of many other substances deemed illegal in Hawaii. Hawaii law also determines the seriousness of various drug crimes based upon whether the substance is categorized as “dangerous,” “detrimental,” or “harmful.”

Simple drug possession is the most common variety of drug crime with which a person may be charged. Merely possessing an illegal drug in Hawaii can be a serious offense. Additionally, often a possession of drug paraphernalia charge can accompany a simple possession charge. More serious criminal charges are often brought for the person selling or manufacturing illegal drugs. These types of criminal charges can involve long prison sentences; especially in the federal court which often come with long mandatory minimum sentences.
