Honolulu Assault in the Third Degree Lawyer

Assault crimes in Hawaii are separated into three categories that range in severity. Depending on the severity of the assault, you could be charged with first, second, or third-degree assault, with first-degree assault being the most serious. First and second-degree assaults are felonies, and third-degree assaults are misdemeanors.

Assault in the third degree §707-712 (1) A person commits the offense of assault in the third degree if the person:

  • Intentionally, knowingly, or recklessly causes bodily injury to another person; or
  • Negligently causes bodily injury to another person with a dangerous instrument.

(2) Assault in the third degree is a misdemeanor unless committed in a fight or scuffle entered into by mutual consent, in which case it is a petty misdemeanor.

Assault in the State of Hawaii may be charged in three degrees. Assault in the third degree is the least serious offense. To be convicted of Assault in the third degree, the government must prove beyond a reasonable doubt that an individual intentionally, knowingly, or recklessly caused bodily injury to another person; or that this individual negligently caused bodily injury to another person with a dangerous instrument.
