Assault in the third degree §707-712 (1) A person commits the offense of assault in the third degree if the person:

- Negligently causes bodily injury to another person with a dangerous instrument.
(2) Assault in the third degree is a misdemeanor unless committed in a fight or scuffle entered into by mutual consent, in which case it is a petty misdemeanor.
Assault in the State of Hawaii may be charged in three degrees. Assault in the third degree is the least serious offense. To be convicted of Assault in the third degree, the government must prove beyond a reasonable doubt that an individual intentionally, knowingly, or recklessly caused bodily injury to another person; or that this individual negligently caused bodily injury to another person with a dangerous instrument. Assault in the third degree is a misdemeanor, punishable by up to a year in jail and a $2,000 fine and restitution unless committed in a fight or scuffle entered into by mutual consent, in which case it is a petty misdemeanor, punishable by up to 30 days in jail, $1,000 fine, and restitution.
