Honolulu Appeals Lawyer | Attorneys for Freedom Law Firm

Honolulu Appeals Attorney

If you need an Appeals Attorney in Honolulu, that means things did not go well for you with your case. But, the fight is not over. Unless you formally waived your right to appeal, you may still be entitled to relief from the appellate court. Even if you did formally waive your right to an appeal because you cannot waive all your rights, you may still have a legal avenue to pursue. The key is, finding an experienced and aggressive appeals attorney. Not all criminal defense attorneys have the experience to effectively represent clients in appellate court.

You need an experienced criminal defense attorney who knows what issues can be raised on appeal. There may have been legal issues at your trial that an experienced appeals attorney could use to file a successful appeal in your case. These issues could include problems with the jury, such as jury selection, jury instructions, or juror misconduct. Other possible issues may include, evidentiary issues, prosecutorial misconduct, failure to suppress unconstitutionally obtained evidence, or other erroneous judicial decisions.

Reasons to file an appeal may include:

  • Newly discovered information
  • Legal errors at trial or sentencing
  • Insufficient evidence
  • Misconduct

If your lawyer does not know what issues to raise, it could be the difference between a successful appeal or an unsuccessful appeal. The lawyers at The Attorneys for Freedom Law Firm have many years of experience in all these areas. We are experienced in both state court appeals as well as federal appeals.

There are also time limits to be aware of as well. Before any of these issues can be raised, it is important to file a timely notice of appeal, followed by a properly written and persuasive appellate brief. These issues will then require an experienced appellate attorney to argue these issues in appellate court. Our attorneys have experience in all aspects of appellate litigation.

It is important to note that in cases where a defendant accepted a plea bargain, the right of appeal is usually waived if the plea agreement is accepted and followed. But, even in those cases, you still may seek relief in the form of what is known as collateral review or a federal 2255 post-conviction relief proceeding.

The Attorneys for Freedom Law Firm has represented hundreds of clients in both state and federal appellate matters, as well as state and federal post-conviction proceeding matters. We also have experience successfully arguing appellate issues before the 9th Circuit Court of Appeals in San Francisco.

I want to express my gratitude to Attorneys for Freedom, especially to Emma Wittman and Greg Fitzpatrick, for their exceptional work in assisting me with a very stressful situation. When I called the emergency hotline, Emma managed my case with respect, speed, and efficiency. She was crucial in finding the right attorney to represent me in my state. They devoted considerable time to ensuring the attorney was the right fit for me. I have been meaning to write this review for some time now. (Sorry for the delay Marc) I am a newer member of AOR and thankfully haven't had to use any of the services that come along with being a member. I do want to speak to the exceptional customer service I have received both before signing up and after. I think I watched several hours of YouTube videos on all the major plans available and commented on many, including AOR videos to which Marc replied. I know I emailed the firm with general questions multiple times and spoke to members of the firm twice before even signing up. Never once did I feel like they weren't available to answer questions. After signing up I was planning a vacation and reached out the the local sheriff's office about carrying in that state/city. I wasn't given much information at all, so... I reached out to AOR. Marc replied and gave me some general advice and then forwarded my email to a couple of associates at the firm Moises Morales and Pierre B Whyte, the two prepared a thoughtful email with great advice for protecting myself while on vacation. This is the type of service that, in my opinion makes Attorneys for Freedom and the AOR program different.

Feels good to switch from an insurance company to an actual lawyers firm that feels as strongly as I do about the Second Amendment and the right to carry.
