DUI Attorney Chandler Arizona – Many people are under the false assumption that as long as their BAC is not 0.08 or higher that they cannot be charged with a DUI.  A BAC of 0.08 is simply the point at which you are considered legally impaired.  In Arizona, it is unlawful for anyone to drive or be in actual physical control of a motor vehicle while being under the influence of any substance.  Substances can include any intoxicating liquor, any drug, any vapor releasing substances containing a toxic substance or any combination of liquor, drugs or vapor releasing substances.  In Arizona, a person needs only be impaired to the slightest degree to be guilty of the crime of DUI.  Depending solely on the judgment of your arresting officer and the discretion of the court, you can still be charged with a DUI in Arizona, even if you have a BAC less than 0.08.  Being impaired to the slightest degree applies to not only alcohol but any drug whether legal or illegal as well, including over the counter drugs.  Anything that impairs your ability to the slightest degree can be considered driving under the influence.  So don’t get caught up in numbers, you do not have to be 0.08 to be charged with DUI.

Let’s be honest, DUI laws are really nothing more than a way for the government to raise revenue.  In fact, DUI laws are not even needed, as we already had laws on the books to address the problem of people driving while impaired.  For more on this, please read my article entitled, Abolish All DUI Laws.  But, the fact remains you will be charged with the crime of DUI if you are found to be driving your vehicle while impaired to the slightest degree.  Please understand, I am in no way advocating for allowing people to drive recklessly or in ways that put other drivers in danger. We already have laws that can be used to charge someone with driving impaired.  DUI laws are not needed and are too broad and overreaching.  If you are stopped by an officer and suspected of driving under the influence, never play those games on the side of the road.  You are not required to do so, and you should always politely decline those tests on the side of the road. If you are arrested and taken into custody, you are required to submit to a breath, blood or urine test at that point.  Failure to do so will result in a suspension of your drivers license for up to a year.
