Chandler Drive-by Shootings Lawyer

Drive-by Shootings are listed in the Arizona Revised Statutes under A.R.S. § 13-1209 as Class 2 Felonies. A person commits a drive-by shooting by intentionally discharging a weapon from a motor vehicle at a person, another occupied motor vehicle, or an occupied structure.

Motor Vehicle

A motor vehicle is defined in ARS § 28-101(50) as “a self-propelled vehicle” or “for the purposes of the laws relating to the imposition of a tax on motor vehicle fuel, a vehicle that is operated on the highways of this state and that is propelled by the use of motor vehicle fuel.”

Occupied Structure

An occupied structure as defined in A.R.S. § 13-3101 is “any building, object, vehicle, watercraft, aircraft or place with sides and a floor that is separately securable from any other structure attached to it, that is used for lodging, business, transportation, recreation or storage and in which one or more human beings either are or are likely to be present or so near as to be in equivalent danger at the time the discharge of a firearm occurs. An occupied structure includes any dwelling house, whether occupied, unoccupied, or vacant.”

Drive-by shootings are usually associated with gang-related activities, but unfortunately, road rage can also lead to someone intentionally discharging a weapon from a motor vehicle at another person.

This crime can be associated with an allegation of dangerousness, which can serve as a sentence enhancement. If you are charged with this crime, you can expect to be facing very harsh punishments. Because of the nature of this crime, it is a mandatory prison offense for those who are convicted. For first-time offenders, this crime carries a mandatory prison sentence of at least 7 years and a presumptive term of 10 1/2 years. You could face up to 21 years in prison for a first-time offense.

I recently had a double bill of my wife's membership that I caught on my credit card bill. I called and spoke to Noslen in customer service, she was able to figure out that when my wife upgraded to the new AOR service that she was double billed and took care of the error right away. That was good enough for me to be happy with her service, but she called me back right away and asked if I had been double billed the month before when I upgraded my subscription.
