Chandler Wrongful Death Lawyers

A wrongful death lawsuit is a civil action by the survivors of the deceased. The purpose is to receive compensation due to the negligence or misconduct of another party that resulted in the death of an individual. A wrongful death claim can only be filed if the deceased would have been able to file a personal injury claim themselves, had they survived the incident that resulted in their death.

“Wrongful Death” is the taking of a life “caused by [a] wrongful act, neglect, or default” of another person or corporation. See, Arizona Revised Statute 12-611. In addition, Arizona Revised Statute 12-542 holds that a wrongful death action “shall be commenced…within two years after the cause of actions accrues.” However, there are exceptions to the two-year deadline.

Anyone who has suffered through the death of a loved one knows it is devastating and upsetting, especially if the death was due to the negligence of an individual or corporation. Wrongful death can occur from car and motorcycle accidents to complicated medical malpractice or product liability injuries.

Who Can Sue for Wrongful Death?

Arizona law allows two separate and distinct types of wrongful death: (1) a wrongful death action and (2) a survival action. The latter permits recovery for the estate and the former is for the wrong to the beneficiaries. These claim types of claims are defined in Arizona Revised Statute 12-612.

Those who can sue are:

  • Surviving spouse of the deceased (wrongful death claim)
  • Surviving children of the deceased (wrongful death claim)
  • Surviving parent or guardian of the deceased (wrongful death claim)
  • A personal representative of the decedent’s estate (survival action claim)

Wrongful death claimants can recover for grief, mental anguish, and relationship losses such as love, care, and companionship. According to Arizona Revised Statute 12-613, the amount recovered “shall not be subject to debts or liabilities of the deceased.”

Survival actions are for the recovery of burial costs, medical expenses, and the loss of decedent’s economic losses, including future income. Only one claim can be made in a person’s wrongful death, and in most cases the same law firm can represent all the parties involved, i.e., beneficiaries, involved with no conflicts of interest.

Thankfully I have not had to utilize AOR's legal services, but I am thoroughly impressed with everything that they provide, everything that they legally stipulate, as well as their customer service team. I had many questions that I would periodically call back to ask about, and both Noslen and Stacy were so incredibly helpful and patient! Noslen follows up so well and Stacy is so fun to talk to! They are selling a product that they can stand behind, and I so appreciate that they trust the free market to decide. I called USCCA in this process to understand what they offer as well and, unfortunately, the USCCA representative that I spoke to resorted to an ad hominem argument against AOR that did not stand up to the facts after I did some basic research and read through AOR's policies and agreements. Overall, my husband and I are grateful that AOR exists, especially for those who live in states that are not self-defense friendly, and that they seem to be able to back up what they say!

I haven't had to use my membership benefits yet and hope to never need to BUT the peace of mind knowing it's there is HUGE. Everyone says they would rather be tried by 12 vs. carried by 6 and I agree although if that's your logic, you may want to have a good lawyer to help you during your trial. This is the most affordable way to get that done

In my 2nd year of being a member with AOR. I appreciate knowing they would be there for me if I need them, without looking for exclusion reasons to not do their promise. Thanks AOR!

I love AOR and glad to be a member and affiliate. I hope I never have to use them but it gives me a peace of mind knowing if I ever do, they got my back. Big Thank You to Mr. Belcher. I ran a flyer idea by them due to me being a freedom affiliate and not having a hug following to be an armed affiliate. He informed me that goes against the guidelines and I immediately apologized and assured him I wouldn’t be using them flyer and deleted it from my device. He said he loved my enthusiasm for AOR and he will get with his business development team and brainstorm how they can support me and my individual needs as a freedom affiliate. Fingers crossed he can make something happen but if not, im still proud to be a member.
Response from the owner:Thank you for the thoughtful review, Kay! We truly appreciate your enthusiasm for AOR and your support as both a client and affiliate. We’re glad James was able to provide clear guidance and take the time to understand your ideas and individual needs. We’re grateful to have you as part of the AOR community and truly appreciate your trust in our team!
