Underage DUI (also known as a baby DUI) A.R.S. §4-244 (34-35) – It is unlawful for a person under twenty-one years of age to drive or be in physical control of a motor vehicle while there is any spirituous liquor in the person’s body. In addition, it is unlawful for a person under twenty-one years of age to operate or be in physical control of a motorized watercraft that is underway while there is any spirituous liquor in the person’s body.
In Arizona, the penalties for an underage DUI are even stricter than those for drivers who are over 21 years of age. If an underage driver is suspected of DUI and their BAC is anything above 0.00%, the driver will be cited for driving under the influence. In addition to being charged under A.R.S. § 4-244(34), an underage driver can be charged with a regular DUI, extreme DUI, or a super extreme DUI.
Penalties
An underage driver convicted of being impaired to the slightest degree will face a minimum of ten days in jail, nine of which can be suspended if alcohol screening and treatment is completed. In addition, the underage driver will face fines and assessments totaling $1,250, and a two-year license suspension. A second offense within 7 could result in increased jail time, higher fines, and a longer driver’s license suspension. Depending on the circumstances, there could be additional charges as well.

- Identity theft.
- Refusing to provide a truthful name when detained.
- Various traffic violations.
