Underage DUI (also known as a baby DUI) A.R.S. §4-244 (34-35) – It is unlawful for a person under twenty-one years of age to drive or be in physical control of a motor vehicle while there is any spirituous liquor in the person’s body. In addition, it is unlawful for a person under twenty-one years of age to operate or be in physical control of a motorized watercraft that is underway while there is any spirituous liquor in the person’s body.

In Arizona, the penalties for an underage DUI are even stricter than those for drivers who are over 21 years of age. If an underage driver is suspected of DUI and their BAC is anything above 0.00%, the driver will be cited for driving under the influence. In addition to being charged under A.R.S. § 4-244(34), an underage driver can be charged with a regular DUI, extreme DUI, or a super extreme DUI.

Penalties

An underage driver convicted of being impaired to the slightest degree will face a minimum of ten days in jail, nine of which can be suspended if alcohol screening and treatment is completed. In addition, the underage driver will face fines and assessments totaling $1,250, and a two-year license suspension. A second offense within 7 could result in increased jail time, higher fines, and a longer driver’s license suspension. Depending on the circumstances, there could be additional charges as well.

Other charges may include:

  • Minor in possession of alcohol.
  • Soliciting alcohol.
  • Possessing a fake ID.
  • Identity theft.
  • Refusing to provide a truthful name when detained.
  • Various traffic violations.

Other consequences include higher insurance rates once driving privileges are restored and a DUI on your record. This could affect your employment prospects as well as educational opportunities and scholarships. An underage DUI could have long-lasting consequences.

The best way to avoid an underage DUI is to not consume any alcohol or drugs before driving. But, if you are charged with an underage DUI, you should consult with a criminal defense attorney who is experienced with underage DUI law. An experienced DUI attorney may be able to raise defenses for your charges.

After must research, I found AOR, best decision I made was to join. Stay safe out there!

I am grateful to James Belcher of AOR for helping to navigate me through the process of signing up as a new member. He even answered me a year later when I contacted them again to finally switch over. I spend over an hour talking with him and he answered all my questions and made the process easy and fun.

I was with another company for 6 years, but found out that if my case went to retrial or if I was found guilty and wanted to appeal I would be responsible for all the legal cost. Not with AOR as they will continue to cover me and help with the appeal process.

There were also tons of other legal exclusions with my former company, but with AOR has its all covered which I love. They aren't an insurance company they are actual attorneys. I feel more secure with their legal services on my side.

Thank you.
