Chandler Straw Purchase of a Firearm Lawyer

Straw Purchase of a Firearm is a federal crime. A straw purchase is when the buyer is receiving the goods or services on behalf of a third party. Straw purchases of firearms are illegal, as many prohibited possessors will use this as a means to avoid a background check.

If you legally purchase a firearm from a licensed dealer, you will be required to fill out Federal Form 4473 at the time of purchase. This form will be kept on file with the ATF (Bureau of Alcohol, Tobacco, Firearms, and Explosives). Question 11 on form 4473 specifically asks if the buyer is the actual “transferee/buyer” of the weapon.

There is also a warning:

“Are you the actual transferee/buyer of the firearm(s) listed on this form? Warning: You are not the actual transferee/buyer if you are acquiring the firearm(s) on behalf of another person. If you are not the actual transferee/buyer, the licensee cannot transfer the firearm(s) to you. Exception: If you are picking up a repaired firearm(s) for another person, you are not required to answer 11.a. and may proceed to question 11.b. (See Instructions for Question 11.a.)”

It is a federal crime under 18 U.S. Code § 922 to lie or mislead the seller about the identity of the ultimate possessor of the firearm. Since this is a federal crime, you will need to consult with a criminal defense attorney who is licensed to practice in federal court.
