Possession or Use of Drug Paraphernalia – A.R.S. § 13-3415 is a class 6 felony offense in Arizona. Drug paraphernalia can be broadly defined to include almost anything. Drug paraphernalia commonly refers to items that are used to smoke drugs such as pipes or other smoking devices, needles that are used to inject drugs, and containers that could be used to store drugs. Other items may include scales, used to weigh drugs, baggies, or tinfoil, used to transport drugs, and many other items. Drug Paraphernalia charges are almost always included with illegal drug possession charges.

Except as provided in section 36-2852 and section 36-2853, subsection C, it is unlawful for any person to use, or to possess with intent to use, drug paraphernalia to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale or otherwise introduce into the human body a drug in violation of this chapter.

Note: with the passage of Proposition 200, if the conviction is a first or second (non-violent) offense for the possession or use of drug paraphernalia, you can only be sentenced to probation, instead of jail or prison. However, if you violate probation, you can be taken into custody and spend up to several weeks in jail until your probation is reinstated.

You should never travel with drugs or drug paraphernalia in your vehicle. Many times, police officers will stop someone for a simple traffic violation and notice drug paraphernalia in plain sight, this could lead to a class 6 felony charge of Possession or Use of Drug Paraphernalia. The officer does not need cause if the drug paraphernalia is in plain sight. You should never consent to a search of your vehicle or person, but if the officer has cause, he will search your vehicle anyway.
