Chandler Marijuana DUI Lawyers
Most people think of alcohol when the subject of DUI comes up, but you can also be charged with a DUI for driving under the influence of marijuana as well. In Arizona, you can be guilty of DUI if you are impaired to the slightest degree, and that not only applies to alcohol but marijuana and other drugs as well.
It is unlawful for a person to drive or be in actual physical control of a vehicle in this state under any of the following circumstances:
- While under the influence of intoxicating liquor, any drug, a vapor releasing substance containing a toxic substance or any combination of liquor, drugs, or vapor releasing substances if the person is impaired to the slightest degree.
- If the person has an alcohol concentration of 0.08 or more within two hours of driving or being in actual physical control of the vehicle and the alcohol concentration results from alcohol consumed either before or while driving or being in actual physical control of the vehicle.
- While there is any drug defined in section 13-3401 or its metabolite in the person’s body.
- If the vehicle is a commercial motor vehicle that requires a person to obtain a commercial driver’s license as defined in section 28-3001 and the person has an alcohol concentration of 0.04 or more.
Although Prop 207 changed the marijuana laws in Arizona, it is still illegal to operate a motor vehicle if you are under the influence of marijuana. Much like alcohol, if you are convicted for a marijuana DUI, it can have serious repercussions on your life. You could be facing either jail or prison time, stiff fines, and a criminal record. Also, having a valid medical marijuana card will not protect you if you are charged with a marijuana DUI.
With all the changes in the law concerning marijuana, it is important that you contact an experienced criminal defense attorney if you have been charged with a marijuana DUI. An experienced attorney may be able to raise possible defenses such as the level of cannabis metabolite in your system was not enough to cause impairment.
