First-Degree Murder ARS 13-1105

Murder is one of the most serious crimes someone can commit, with first-degree murder being the most serious of all. Because Arizona has the death penalty for first-degree murder convictions, a first-degree murder conviction could be a life-ending sentence, depending on the facts in the case. Even if you are not sentenced to death, you could spend the rest of your life in prison.

A person commits first-degree murder if:

  • A person intends or knows that the person’s conduct will cause death;
  • Does, in fact, cause another person’s death; and
  • Committed the act with premeditation.

First-degree murder is a class 1 felony and is punishable by death or life imprisonment as provided by sections 13-751 and 13-752.

In Arizona, someone can also be charged with first-degree murder if death occurs during the commission of certain felonies.

These felonies include:

  • Sexual conduct with a minor
  • Sexual Assault
  • Molestation of a child
  • Terrorism
  • Certain marijuana offenses
  • Dangerous drug offenses which exceed the statutory threshold amounts
  • Narcotics offenses
  • The use of minors in drug offenses
  • Drive by shooting
  • Kidnapping
  • Burglary
  • Arson
  • Robbery
  • Escape
  • Child Abuse
  • Unlawful flight from a pursuing law enforcement vehicle

In addition, you do not have to be the one who actually committed the murder, to be convicted of first-degree murder. An example might be someone who simply drove the car in a bank robbery and never entered the bank at all. If another person involved in the robbery shoots and kills someone during the robbery, the person who drove the car could be found just as guilty as the person who pulled the trigger. This is known as accomplice liability.

I think AOR is the best option and have just received my renewal. The firm refuses to answer this question: Has AOR ever represented anyone in my geographic area? No names, no details, just that question and they won’t answer it for “confidentiality” reasons. Strange I think.
Response from the owner: Thank you so much for your 5-star review, William! We have represented several people in different states on the east coast over the past 30 years. Attorney Andy Marcantel just appeared in a FL courthouse this week.  However, we have not yet had a case in NC.
