Endangerment, or A.R.S. § 13-1201, can be charged as either a misdemeanor or a felony in Arizona. Under A.R.S. § 13-1201,

  1. A person commits endangerment by recklessly endangering another person with a substantial risk of imminent death or physical injury.
  2. Endangerment involving a substantial risk of imminent death is a class 6 felony. In all other cases, it is a class 1 misdemeanor.

Recklessness is defined as: a person is aware of and consciously disregards a substantial and unjustifiable risk that a certain result will occur or that a certain circumstance exists. The risk must be of such a nature and degree that disregard for such risk constitutes a gross deviation from the standard of conduct that a reasonable person would observe in the situation.

The law is very broad in the area, and you could be charged with endangerment for not only using a firearm but any weapon or dangerous instrument as well. A dangerous instrument could be almost anything, such as a boot or an automobile.

If you discharge a firearm in Arizona, you can be charged with endangerment even if no one was hurt or you had no intent to injure anybody. An example of this would be recklessly firing a gun into the air. Even if the round did not hit anyone, you could still be charged with endangerment.

Misdemeanor endangerment, although not as serious as felony endangerment, is still a serious offense that could result in jail time and fines up to $2,500 if convicted.
Felony endangerment is a more serious crime that could include prison time. Felony endangerment for first-time offenders can include prison time up to 2 years for those convicted.

I love AOR and glad to be a member and affiliate. I hope I never have to use them but it gives me a peace of mind knowing if I ever do, they got my back. Big Thank You to Mr. Belcher. I ran a flyer idea by them due to me being a freedom affiliate and not having a hug following to be an armed affiliate. He informed me that goes against the guidelines and I immediately apologized and assured him I wouldn’t be using them flyer and deleted it from my device. He said he loved my enthusiasm for AOR and he will get with his business development team and brainstorm how they can support me and my individual needs as a freedom affiliate.
