Burglary Defense Strategies
Proof of a trespass on to someone else’s property, by itself, is insufficient to prove Burglary. The State must also prove that the defendant had the intent to commit a crime once they entered the property. The fact that the State must prove the intent of the defendant often proves difficult, and can provide an avenue for a successful defense. Defense strategies we utilize when defending our clients in this area include:
•Showing a lack of intent to commit a trespass
•Showing a lack of intent to commit a crime subsequent to a trespass
•Casting doubt on the prosecution’s theory of events
•Challenging the State’s evidence
•Developing alternate defenses, such as alibi, impossibility and mistaken identity
•Plea bargain negotiations when necessary
