Chandler Theft Crimes Lawyer

Theft A.R.S. § 13-1802 is a very broad crime in Arizona and can be charged as either a misdemeanor or a felony, depending on the circumstances involved in the crime.

If the property or services stolen is valued under $1,000.00, theft may be charged as a class 1 misdemeanor. This class of theft is also known as “petty theft,” which includes shoplifting crimes where the property value is smaller.

Penalties for a first-time offender convicted of misdemeanor theft can include:

  • Restitution (repayment of the stolen property)
  • Fines
  • Probation
  • Jail time

Felony Theft

You can be charged with felony theft in Arizona if the value of the stolen property exceeds $1000.00. Felony theft crimes range from a class 6 felony up to a class 2, with a class 2 offense being the most serious. The classification will be made depending on the value of the property that was stolen.

  • Class 6 Felony Theft – Stolen property or services valued between $1,000-$2,000
  • Class 5 Felony Theft – Stolen property or services valued between $2,000-$3,000
  • Class 4 Felony Theft – Stolen property or services valued between $3,000-$4,000
  • Class 3 Felony Theft – Stolen property or services valued between $4,000-$24,999
  • Class 2 Felony Theft – Stolen property or services valued at $25,000 and above.

The Statute of Limitations for theft crimes in Arizona is (7) seven years. This means that someone could be charged with theft up to (7) seven years after the actual crime was committed.

Penalties for a first-time offender convicted of felony theft can include:

Class 6 Felony Theft
Probation or between four months and a maximum of 2 years in prison.
Class 5 Felony Theft
Probation or between six months and a maximum of 2.5 years in prison.

If the dollar amount alleged exceeds $100,000.00. the person is not eligible for probation and must serve a prison sentence of between 3 and 12.5 years.

A felony theft conviction in Arizona can have life-long consequences. In addition to the possibility of going to prison, a felony theft conviction can affect your ability to get a job, rent housing, get a scholarship, get a professional license, and more. Attorneys for Freedom law firm represented a family member in a serious felony case that went to trial. The family member was facing possible decades in prison if convicted of the false allegations. While the family member was innocent of all the charges leveled against him, we used the expertise of veteran lawyers at Attorneys for Freedom to lead the way through the intricacies of the court system. After weeks of trial, he was found NOT GUILTY.
Joey Hamby and Andy Marcantel did an outstanding job in not only representing the family member in court but also researching all aspects of the case prior to trial. These two experienced trials tested lawyers spent hours with us in preparation to make sure they had all the facts in the case to defend the family member in the best possible way. Those hours paid off from not only working to select the best jurors possible and arranging the correct witnesses to testify on my son's behalf but also defending his rights before the judge and making a solid defense in front of the jury. We want to thank Joey and Andy for walking with us through this horrible ordeal and being at our side every step of the way.
In a serious felony case like this one, you want the best representation possible. We selected the absolute best in Attorneys for Freedom!
