Many people believe that with the passage of Prop 207 in Arizona that marijuana is now legal. Well, not exactly. It’s true that adults can now possess up to 2.5 ounces of marijuana in Arizona. But, if marijuana were truly legal, you would be able to possess, grow, sell, and buy as much as you wanted, much like tomatoes, potatoes, and carrots, but that’s not the case. What Prop 207 actually did was decriminalize marijuana with limits on how much you can possess, buy, sell, and grow. It should also be noted that marijuana is still illegal at the Federal level.
But you can still get into legal trouble in Arizona if you are not within the limits of Prop 207. For example, you can also grow a limited amount of marijuana for personal use. If you are of legal age (21 years of age or older), you are allowed up to 6 marijuana plants in your home, and if there are multiple adults in the home, you can have up to 12 marijuana plants. Keep in mind, this is 12 total plants per household, not 6 plants per adult.
Arizona Revised Statutes § 36-2852 legalizes possessing or consuming marijuana, but with limits. If you are growing more than what is the legal limit, you can still be charged with cultivation or growing of marijuana in Arizona. This is a more serious crime, unlike simple possession of marijuana for personal use.
In addition, if you are growing marijuana, it must be for personal use. It is still illegal to sell marijuana unless you are a dispensary with proper licensing. However, you are allowed to give other adults marijuana if it is not sold to them. Also, the marijuana plants must be kept secure, and not visible to the public or minors. The grow area must be a closed enclosure that can be locked.
Private sales of marijuana are still not allowed under Prop 207, and there are new restrictions for dispensary owners. So, even if you are licensed to sell marijuana in Arizona, you need to be careful and make sure you understand what the law is, in regard to Prop 207.
