  4. Manufacture a dangerous drug.
  5. Administer a dangerous drug to another person.
  6. Obtain or procure the administration of a dangerous drug by fraud, deceit, misrepresentation, or subterfuge.
  7. Transport for sale, import into this state or offer to transport for sale or import into this state, sell, transfer, or offer to sell or transfer a dangerous drug.

However, ARS 13-3407 does not specify what the definition is for “possession for sale.” In addition, it also does not define what “transportation for sale” is. The difference between possession and possession for sale is the amount of the drug that you have in your possession. If the amount of drugs that were found on the defendant is over the threshold amount, it will usually be assumed that there was an intent to sell involved.

  • Methamphetamine – 9 grams
  • Cocaine – 9 grams
  • LSD – 1/2 ml (liquid form), 50 dosage units (blotter form)
  • Marijuana – 2 pounds
  • PCP – 4 grams or 50 ml

The crime of possession of drugs for sale or intent to sell have more severe punishments than simple possession for personal use. The punishments for this crime may include prison terms of up to 12.5 years or more for a first-time offense.
